Sources say Amicus Brief appears designed to usurp right of political parties to determine Ballot Access

For over a year The Georgia Record has been reporting on the quiet emergence of “Republican Coalitions” incorporated in a number of Counties by Brent Herrin (a Kemp appointee.) The purpose of these “coalitions” has been obscured.
Created as corporations under Title 14 of Georgia law, these coalitions are not a political party. Political parties are organized and governed under Title 21 a completely different part of the law in Georgia.
When questioned about the issue of these “coalitions” last year, now-GOP Chair Josh McKoon reported that he had spoken to Brent Herrin and these organizations had been created “in case” someone wanted them.
New analysis now suggests that the Amicus Brief, written by Brent Herrin, appears to be in part an attempt to usurp the role of political parties in determining "Ballot Access". The actual Political Parties have long held the responsibility to determine the candidates within their respective parties who are placed on the ballots during Primary Elections. The apparent attempt to assert that a simple Corporation (which doesn't answer to the same rules and laws as a Political Party) could somehow put forth their "candidates" has many in Georgia raising alarm bells.
The coalitions now exist at least on paper in over 20 Counties representing more than half the population of the State of Georgia. Why those Counties and why now?
Now in Catoosa County, the very same Brent Herrin who filed documents incorporating these coalitions, has filed an Amicus brief which seems designed to assert that the “The Georgia Republican Coalition, Inc.” and the associated “coalitions” can insert themselves in the processes that influence and govern Georgia primary and election processes.

Many find it interesting that after avoiding previous explanation of the coalitions creation, that Herrin now chose to file an amicus brief in an attempt for the coalitions to seemingly be treated with standing with respect to our elections.
We have reported in depth in previous articles about the differences in the laws governing corporations versus those law which govern political parties and their actions with regard to ballot access and elections. Those differences are by design and experts say no amount of arguing will allow a corporation to assume the role of a party – they are distinct and cannot act as the other legal entity.
In his brief Herrin attempts to portray the actual Republican Party as some sort of smoky backroom-dealing organization when in truth the coalitions appear to fit such a model much more closely.
Citizens in Cherokee County have reported that the “coalition” formed there requires people who wish to participate to be “vetted” prior to actually joining the organization.
When the first coalition was reportedly formed, Georgia House Rep. Jordan Ridley was said to be a part of the team. This reporter called Mr. Ridley and asked what the purpose of the coalition was. Mr. Ridleys answer was that the creation was really no surprise in light of Kemp’s statements regarding moving away from the traditional Republican Party.
In 2023 Kemp urged donors to ditch the Republican Party
“we can no longer rely on the traditional party infrastructure to win in the future.”
Kemp appointed Brent Herrin to the Georgia Composite Board of Professional Counselors, Social Workers, and Marriage and Family Therapists in 2021.
GOP Chair Josh McKoon serves as counsel to the Technical College System of Georgia. Kemp appointed the Technical College Board, who appointed McKoon.
The GA GOP and their Chair, Josh McKoon, has consistently refused to explain why the GA GOP can produce no documents required under Federal Election law and Georgia Law from the Georgia Republican Party and instead produce documents from the Georgia Republican Party, Inc. (We’ve shown that parties and corporations are not, and can not, be interchangeable.)
The Georgia Republican Coalition is using the name “Georgia Republican” and the logo of an elephant. The Georgia Republican Party has been using that name and that logo for decades.
That name confusion is potentially misleading for the public and for donors.
The officers of the Georgia Republican Party have a fiduciary duty to protect the name and logo.
But they were elected under the rules and articles of a private corporation. Who is a party officer under GA Elections Code? Name them please. Only names filed with GASOS are the corporate officers. There are three - McKoon, Jeffords, and McClain. No party officers appear to be filed.

Which counties? What can citizens do?
Let’s be clear. Josh McKoon, as Corporate CEO & Chairman of the board of a private nonprofit corp, the Georgia Republican Party, Inc. appears to be GIVING everything to Herrin et al. Corp to Corp favor. Coalition Inc. thinks it now can get a similar corp exception to GRP, Inc. At this rate, it could become a political body & win 20% to become a party. This is the latest CORPORATE primary season. Centralized govts tend to want MORE power by illicit means.
Better check the GA SC.
