• Activist Questions Whether Fani Willis Has Jurisdiction To Prosecute Crimes In The Capitol

    Capitol Police have jurisdiction over Capitol grounds and State buildings for miles around.

    Debbie Dooley, a well know advocate for truth and election integrity in Georgia, published an update citing laws and open records requests which create a question about whether Fani Willis even has jurisdiction to pursue charges, when the alleged crime occurred on Capitol/State property.

    I heard back from the Georgia Attorney General's office and the Georgia Department of Public Safety in regard to my open records request. Neither the A.G., nor DPS had any document that granted Willis jurisdiction to usurp the authority of the Capitol Police and A.G. in investigating events that took place at the Georgia Capitol.

    On February 8,2021, a spokesperson for the SoS Office made this statement in a news article:

    “The Secretary of State’s office investigates complaints it receives,” said Walter Jones, a spokesman for Raffensperger’s office, describing the investigation as “fact finding and administrative.”

    “Any further legal efforts will be left to the attorney general.”

    The prosecutorial authority for state matters at the Capitol is the Georgia Attorney General. The SoS and state election board has investigators and can investigate election fraud .

    "The Georgia Secretary of State’s office is charged with administering elections and investigating allegations of election and voter fraud."

    Fani Willis couldn't allow the Georgia Attorney General to conduct the investigation, because she wanted to further her political career by going after Trump. On February 10, 2021, she wrote the letters at the link below to Gov. Kemp, A.G. Chris Carr, Geoff Duncan, and SoS Raffensperger usurping authority to investigate events at the Georgia Capitol. Carr should have responded back telling Willis his office or the Capitol Police have jurisdiction at the Georgia Capitol. The fact is he didn't respond back and appoint her as a special prosecutor, like he normally would have in cases of conflict.

    Willis claims that the Georgia Capitol is in Fulton, so she had authority is ridiculous. You have Federal Buildings/Courthouses in Atlanta, along with other nation's embassies. Will Willis next claim jurisdiction over them?

    If she already had jurisdiction, then why the need to write the letters claiming jurisdiction?

    He posted a clip of his case’s 2019 court proceedings on Instagram. In the video, which has since been deleted, the two stand before a judge, and Willis pats him on the shoulder while he hugs his child, who was brought up to the defense’s table. “It really wasn’t nothing that I was trying to keep a secret ’cause the video is on my page,” he says. “That video right there went viral. I was shooting that out there because I know it’s going to end up coming up,” Mondo says. Mondo says he posted the video to proactively prevent anyone from thinking “weird shit” about his interactions with Willis. There’s been immense controversy surrounding December’s plea agreements in the YSL indictment, and Mondo indicated that he doesn’t want his name anywhere near the speculation. "

    I had heard that 3 months before Willis convened a grand jury to investigate Trump, she hired a PR/Messaging consultant to effectively message her investigation of Trump to advance her political career.

    I filed the following open records requests yesterday with Willis office:

    1. All public records relating to the investigation by the Office (or anyone acting on behalf of or under the direction of District Attorney Willis) of activities pertaining to the 2020 United States Presidential Election, including, but not limited to, records relating to the investigation of activities by former President Donald J. Trump and his associates, Republican presidential electors, members and agents of the Georgia Republican Party, and any other person or official.
    2. All public records relating to any public funds spent on the investigation described in Paragraph 1. This includes contracts or documentation with any public relations firm hired using taxpayer dollars by the District Attorney’s Office since January 1, 2021
    3. All public records relating to office or personal security personnel employed or engaged by the Office since January 1, 2021, and the amount of public funds spent to employ or engage the services of such personnel.
    4. All public records pertaining to any out-of-state travel by District Attorney Willis since January 1, 2021, including, without limitation, the locations and the amount of public funds spent on such travel, itemized by trip.
    5. A complete listing, by case number, of the felony criminal prosecutions currently awaiting trial in the Atlanta Judicial Circuit and a brief summary of the status of each case, including, but not limited to, the date on which an indictment was returned in the case and the charges that remain pending.

    I remind the Office of its obligation under the Open Records Act to utilize the most economical means reasonably calculated to identify and produce responsive, non-excluded documents pertaining to this request, and I ask that, in light of the significant public interest in the matters addressed by this request, that any charge for the search, retrieval, redaction, and production or copying costs for the production of records pursuant to this request be waived by the Office.

    In lieu of a printed response, I ask that all public records that are responsive to this request be formatted as a single PDF file and emailed to me at the following e-mail address: [email protected].

    Fulton County DA Fani Willis Gets Pushback From Georgia Republican Leaders on Forthcoming Possible Trump Indictment

    I don't believe Fulton D A Fani Willis has the authority to investigate potential crimes that took place on Georgia Capitol grounds unless AG Chris Carr transferred those powers to her from Capitol Police and I don't see where Carr did that..

    Georgia law is very clear that the Capitol Police have jurisdiction over investigatory and law enforcement matters in the Georgia Capitol and buildings within a 5 mile radius of the Capitol that are state owned buildings.

    The Georgia Capitol Campus entity belongs to the state and state officials have jurisdiction. Counties don't have jurisdiction unless they have been granted it with a legal instrument by the Attorney General. To my knowledge, I couldn't find that Carr had given Willis power to usurp the authority of the Capitol Police.

    This was done decades ago so counties couldn't claim jurisdiction for nefarious purposes like punishing/harassing legislative officials for legislation they vote on etc.

    When I filed an ethics complaint against then Senate Rules chair Don Balfour years ago for falsifying expense reports, the Attorney General's Office took over investigation and prosecution, not the Fulton D.A.

    Ms. Willis sent letters to Carr, Raffensperger, Geoff Duncan, and Kemp in February of 2021 claiming jurisdiction to investigate Trump, senate hearing on 2020 election, alternate electors, etc. Willis is trying to criminalize investigating potential election fraud. She can claim jurisdiction all she wants to, but her email doesn't give her jurisdiction over events that took place in the Georgia Capitol Campus.

    I submitted open records requests below to find out if she was authorized to take jurisdiction.

    To: Georgia Attorney General Chris Carr

    Pursuant to the Georgia Open Records Act (O.C.G.A. § 50-18-70 et seq.), I am requesting the following records:

    Georgia Code 35-2-122 (a) gives law enforcement jurisdiction at the Georgia Capitol and a 5 mile radius around the Capitol to the Georgia Capitol Police.

    (a) The division shall have jurisdiction and the primary duty to enforce all laws in Capitol Square and the property and buildings owned by the Georgia Building Authority within a five-mile radius of Capitol Square.

    I am requesting all legal instruments the Attorney General’s Office is in possession of that legally transferred or conveyed to the Fulton County District Attorney’s Office, or any other legal authority, that allowed them to usurp the clear investigatory authority of the Georgia Capitol Police in buildings under the Georgia Building Authority control.

    Please provide the legal instruments I am requesting, so I can better understand how local district attorneys were able to usurp the investigative authority from Capitol Police for matters that took place in the Georgia Capitol.
